Terms & Conditions

By accessing or using PenguStore, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Platform.

PenguStore is a peer-to-peer digital goods marketplace that connects independent sellers with buyers. We facilitate transactions but are not the seller of any digital goods listed on the Platform.

We do not guarantee the availability of any particular product or seller. Listings are subject to change without notice.

You must be at least 18 years of age to create an account. You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or use another person's account without permission.

You are responsible for all activities that occur under your account.

When you place an order, you enter into a direct contract with the seller. PenguStore facilitates the transaction but is not a party to the sale agreement.

Buyer Protection: If a seller fails to deliver a product as described within the stated timeframe, you are entitled to a full refund. Disputes must be raised within 24 hours of the expected delivery time.

All sales are final unless a dispute is raised within the dispute window. Refunds are processed to your original payment method.

Sellers must accurately describe all products listed. Misrepresentation of products is grounds for immediate account suspension and reversal of funds.

Sellers are prohibited from listing:

• Stolen, fraudulently obtained, or illegitimate digital goods
• Accounts that violate the terms of service of the originating platform
• Items that infringe on intellectual property rights
• Any goods that are illegal in the buyer's or seller's jurisdiction

PenguStore reserves the right to remove any listing and suspend any seller account at its sole discretion.

PenguStore charges a commission on each completed sale. The current fee structure is displayed in the Seller Dashboard. Fees are subject to change with reasonable notice provided to active sellers.

Buyers are not charged additional platform fees beyond the listed product price.

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to circumvent our fees by completing transactions off-platform
• Engage in chargebacks without first raising a dispute through our system
• Use automated tools to scrape, spam, or abuse the Platform
• Harass, threaten, or abuse other users

All content on the Platform including logos, design, and software is the property of PenguStore. You may not reproduce, distribute, or create derivative works without express written permission.

PenguStore is provided as-is without warranties of any kind. To the maximum extent permitted by law, PenguStore shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

Our total liability to you for any claim arising from use of the Platform shall not exceed the amount you paid in transaction fees in the 3 months preceding the claim.

Many products sold on the Platform relate to third-party games, software, or services that have their own terms of service, end-user license agreements, and rules. PenguStore is an independent marketplace. We are not affiliated with, endorsed by, sponsored by, or officially connected to any game publisher, developer, or third-party platform, and any trademarks or names referenced belong to their respective owners.

Compliance with the terms of any third party, including game publishers, is the sole responsibility of the buyer and the seller. By buying or selling on the Platform you acknowledge that some publishers restrict or prohibit the sale, purchase, or transfer of in-game currency, items, accounts, top-ups, or boosting, and that engaging in these activities may carry risk under those third parties' rules.

You assume all risk arising from your use of products purchased on the Platform. To the maximum extent permitted by law, PenguStore is not responsible or liable for any action taken by a third party as a result of a transaction, including account suspension or termination, removal or rollback of in-game currency or items, or any other penalty imposed by a publisher. Buyer Protection (see Section 4) covers non-delivery and items that are materially not as described within the dispute window; it does not cover penalties or losses imposed by a third party after a product has been delivered.

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting support. Pending transactions will be completed or refunded according to our standard policies before account closure.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through binding arbitration before resorting to litigation.

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or platform notification.
